Days after Oberoi Realty announced that it clocked gross bookings of Rs 8,109 crore from its maiden luxury project Three Sixty North in Gurugram, the Punjab and Haryana High Court has barred fresh allotments in the luxury residential project pending a decision on a complaint before the Haryana Department of Town and Country Planning (DTCP).
The Mumbai-based developer said it would pursue legal recourse against the interim order, adding that the directions neither impact apartments already sold nor halt construction at the project.
The order, dated July 7, 2026, and uploaded on the High Court's website on July 9, was passed in a writ petition filed by Advance India Projects Ltd (AIPL) against the Director, DTCP Haryana, and others.
The complaint alleges violations of foreign direct investment (FDI) norms and other provisions. A division bench of Justices Jasgurpreet Singh Puri passed the order and Sanjiv Berry while hearing a plea filed AIPL in an ongoing writ petition against the director of the DTCP, Haryana, and others.
As part of its directions, the High Court asked the Director, DTCP, to decide the complaint by July 20, 2026, after providing an adequate opportunity of hearing to all stakeholders, including the petitioner.
The High Court said that if the matter cannot be decided on the scheduled date, DTCP has been directed to hear the case on a day-to-day basis and pass a reasoned order within the following two weeks.
Considering the scale of the project and the interests of existing and prospective homebuyers, the court also directed that no further allotments be made and no additional third-party rights be created until the complaint is decided.
Responding to the matter, Oberoi Realty Limited clarified in a stock exchange filing that the High Court's order relates to the pending complaint before the DTCP and should not be construed as a stay on the project itself.
The company said the order does not affect any existing sales already concluded, including those disclosed to the stock exchanges on July 5, 2026.
“There is no stay on the construction of the project. The Company will pursue the necessary legal course of action as may be advised by professional legal counsel," Oberoi Realty said.
The developer also maintained that it does not expect the order to have any adverse material impact on its business or operations.
The matter will now be decided by the DTCP, which has been directed to consider all submissions made by the parties and issue a speaking order.
Three Sixty North is Oberoi Realty's maiden residential project in Gurugram and is located on Golf Course Extension Road. According to the court order, the dispute relates to a 14.816-acre land parcel in Sector 58, Gurugram, where a residential colony with a commercial component is proposed.
AIPL also informed the court that it had got an FIR registered in 2024 against IREO and Oberoi Realty, alleging collusion and cheating in connection with the same land parcel. However, proceedings in the FIR are currently stayed by the Supreme Court, and the matter remains pending.
AIPL has sought a stay on License No. 69 of 2025, issued on May 12, 2025, and the subsequent order dated June 17, 2025, approving the transfer of the development licence to another developer. The company has also claimed rights over the project and sought cancellation of the sale deed executed in favour of Oberoi Realty.
